Oshkosh residents can be fined up to $1000 for fireworks violations

OSHKOSH, WI—(WISS)— In September, the Oshkosh Common Council voted to increase the fines for illegal fireworks in the city. As we get closer to the Fourth of July Holiday, the Oshkosh Police Department reminds residents of the new fines and penalties for illegal fireworks.

In a press release, the Oshkosh Police Department said, “Fireworks may be enjoyable, but they can also cause distress to many in our community, especially those with PTSD or noise sensitivities. Loud explosions can also have a negative effect on pets, causing them undue stress and potential harm.”

Legal Fireworks

In the City of Oshkosh, the following fireworks are allowed:

  • Sparklers
  • Stationary Cones and fountains
  • Toy snakes
  • Smoke bombs
  • Caps
  • Noise makers
  • Confetti poppers (containing ½ grain of explosive

Illegal Fireworks

The City of Oshkosh prohibits the following. Using them in city limits could result in a fine of up to $1000.

  • Roman candles
  • Firecrackers
  • Bottle Rockets
  • Mortars
  • Anything that explodes or leaves the ground
    • Only groups/individuals with governmental-issued permits are allowed to use these types of fireworks within city limits

The OPD will inspect locations that sell fireworks to ensure that illegal ones are not being sold to individuals within the City of Oshkosh who do not possess a permit to buy these fireworks.

Officers will also respond to complaints and contact citizens to determine if a violation has occurred. If so, law enforcement action will occur, and items found to be in violation will be seized to curtail repeat violations and ongoing problems.

Ordinance and Fines

The City of Oshkosh Municipal Codes– Chapter 13 -6 (C) (1) says, “No person may sell, possess or use fireworks, as that term is defined by Section 167.10(1) of the Wisconsin Statutes as may be amended from time to time, within the City; except that the use of fireworks may be allowed by appropriate permit issued by the fire chief.”

Fines

For Juveniles: (not less than)

1st Offense: $100 + $5 Court Costs = $105

2nd Offense: $150 + $5 Court Costs = $155

3rd Offense: $500 + $5 Court Costs = $505

(For Third or subsequent offense within 36 months of conviction)

For Adults: (not less than)

1st Offense: $125 + $170 Court Costs = $295

2nd Offense: $225 + $196 Court Costs = $421

3rd Offense: $1000 + $397.50 Court Costs = $1,397.50
